Travel Agency Agreement

This Travel Agency Agreement ("Agreement") explains the terms that apply when you access our website, contact our travel consultants, request a quotation, or purchase any travel service through Netcare Travels Pvt Ltd ("Netcare Travels", "we", "us", or "our").

By requesting or confirming a booking with us, you acknowledge that you have reviewed and accepted these terms along with any conditions imposed by the airline, hotel, accommodation provider, tour operator, or other supplier involved in your reservation.

1. Our Role as a Travel Agency

Netcare Travels assists customers with arranging and managing travel services including flights, hotels, holiday packages, airport transfers, and other travel-related products.

Many services booked through us are supplied by independent third parties such as airlines, hotels, transportation providers, tour operators, consolidators, and other travel partners. Unless specifically stated otherwise, Netcare Travels does not own or operate these third-party services.

2. Eligibility

You must be legally capable of entering into a binding agreement before making a booking through Netcare Travels.

Customers under the age of 18 should not independently purchase, amend, or cancel travel services unless permitted by applicable law and authorized by a parent or legal guardian.

3. Booking on Behalf of Another Traveller

If you make a reservation for another person, you confirm that you have their permission to provide their information and arrange travel services on their behalf.

You are also responsible for making sure that all travellers included in the booking understand the relevant fare rules, cancellation conditions, supplier requirements, and these terms.

4. Accuracy of Traveller Information

You are responsible for providing accurate and complete information when requesting a booking. This includes passenger names, dates of birth, travel dates, destinations, passport details, contact information, and any other information required to complete your reservation.

For international travel, passenger names should normally match the traveller's passport or other required government-issued identification.

5. Booking Requests and Confirmation

A quotation, enquiry, itinerary proposal, or payment request does not automatically mean that a reservation has been confirmed.

A booking will generally be considered confirmed once the required payment has been successfully processed and a confirmation, ticket, voucher, or booking reference has been issued.

Please review your confirmation carefully and contact us promptly if you notice any incorrect information.

6. Prices and Availability

Travel prices and availability can change frequently. A fare or rate quoted to you is subject to availability until the reservation is confirmed.

Airlines, hotels, and other suppliers may change their fares, taxes, availability, schedules, or other charges without prior notice.

If an obvious pricing or technical error is identified before a booking is completed, we may correct the error and provide you with the updated price before proceeding.

7. Taxes, Fees and Other Charges

Your booking price may include the supplier's fare, applicable taxes, service fees, processing charges, or other amounts presented during the booking process.

Some costs may be payable directly to the travel provider and may not be included in the amount collected by Netcare Travels.

8. Service and Processing Fees

Netcare Travels may charge a booking, consultation, amendment, cancellation, administrative, or processing fee for services provided by our team.

Any applicable Netcare Travels fee will be communicated or displayed before the relevant transaction is completed.

Our service fees may have different refund conditions from the fare or amount charged by the airline, hotel, or other travel supplier.

9. Payment Authorization

By providing payment details or otherwise authorizing a transaction, you confirm that you are permitted to use the selected payment method and authorize the relevant booking charges to be processed.

Depending on the reservation, payment may be processed by Netcare Travels, an authorized payment processor, a booking partner, or the travel supplier directly.

10. Credit and Debit Card Charges

Your bank or card provider may apply charges that are separate from the amount collected for your booking.

These may include foreign transaction fees, currency conversion fees, international processing charges, or other banking fees. Such charges are controlled by your bank or card provider and not by Netcare Travels.

11. Currency Conversion

When a booking or refund involves different currencies, the final amount may vary due to changes in currency exchange rates.

Netcare Travels is not responsible for differences caused by exchange rates used by banks, payment processors, card issuers, or travel suppliers.

12. Changes to a Confirmed Booking

Requests to change travel dates, passenger information, flights, hotels, room types, destinations, or other booking details are subject to the rules of the applicable supplier.

Some reservations cannot be changed once confirmed. Where changes are permitted, additional fare differences, supplier penalties, taxes, and administrative or service charges may apply.

13. Cancellation Policy

Cancellation conditions vary depending on the airline, hotel, fare type, package, supplier, and travel product selected.

Some bookings may be fully refundable, partially refundable, non-refundable, or subject to cancellation penalties.

Customers should review the applicable cancellation conditions before confirming their reservation.

14. Refunds

Refund eligibility will depend on the terms attached to the travel service purchased and the policies of the relevant supplier.

If a refund is approved, it may take time for the supplier, payment processor, bank, or card issuer to complete the transaction.

The time taken for an approved refund to appear in your account is not always within the control of Netcare Travels.

15. Non-Refundable Bookings

Certain discounted fares, promotional tickets, hotel rates, holiday packages, and other special travel products may be sold on a non-refundable basis.

Where a booking is clearly identified as non-refundable, the amount paid may not be returned if you later decide not to travel, except where required by applicable law or agreed by the supplier.

16. No-Shows

If you fail to use a confirmed reservation without cancelling it within the permitted time, the supplier may classify the booking as a no-show.

A no-show may result in cancellation of part or all of your itinerary and may lead to loss of the amount paid.

Airline tickets are governed by the fare rules and conditions of the relevant airline. These rules may differ significantly between fares and carriers.

Hotel information including room descriptions, star ratings, photographs, facilities, check-in policies, amenities, and availability is generally supplied by the hotel or our booking partners.

Requests for a particular bed type, room location, view, adjoining room, smoking preference, or other special requirement are subject to availability and cannot always be guaranteed.

A hotel may request valid identification and a credit or debit card at check-in for security deposits or incidental expenses.

19. Airport Transfers and Other Services

Airport transfers, tours, excursions, transportation, attractions, and other local services may be provided by independent third-party operators.

Customers are responsible for following the supplier's pickup instructions, meeting times, baggage restrictions, identification requirements, and other operational conditions.

20. Supplier Terms and Conditions

Each travel supplier may have its own terms, policies, and restrictions. By booking a service, you agree to comply with the conditions applicable to that supplier.

Failure to comply with supplier requirements may result in denied boarding, cancellation, refusal of accommodation, additional charges, or loss of amounts paid.

21. Passport, Visa and Entry Requirements

Travellers are responsible for ensuring that they have all documents required for their journey, including passports, visas, transit visas, permits, travel authorizations, and other immigration documentation.

Entry requirements vary depending on nationality, destination, transit countries, and individual circumstances and may change without notice.

You should verify current requirements with the relevant embassy, consulate, immigration authority, or other official government source before travelling.

22. Health and Travel Requirements

Customers are responsible for checking any vaccination, medical, testing, insurance, health declaration, or other health-related requirement applicable to their journey.

Travel requirements can change after your booking has been confirmed, so you should verify the latest requirements before departure.

23. International Travel

International travel may involve different laws, immigration rules, security conditions, health requirements, and other risks.

Travellers should review official government travel advice and current destination information before confirming and undertaking international travel.

24. Travel Insurance

Customers are encouraged to consider suitable travel insurance before travelling.

Depending on the policy purchased, insurance may provide protection for certain cancellations, emergencies, medical expenses, delays, baggage loss, or other unforeseen events.

Insurance coverage and claims remain subject to the terms and exclusions of the relevant insurance provider.

25. Schedule Changes by Airlines or Suppliers

Airlines and other travel suppliers may change departure times, routes, flight numbers, aircraft, accommodation arrangements, or other parts of a reservation after confirmation.

Where we receive notification of a significant change, Netcare Travels will make reasonable efforts to inform the customer using the contact information available in the booking.

Rebooking, refunds, credits, or alternative arrangements will remain subject to the relevant supplier's rules and applicable law.

26. Events Beyond Our Control

Travel services may sometimes be disrupted by events that neither Netcare Travels nor the relevant supplier can reasonably control.

Refund, rebooking, or alternative travel options in such circumstances will depend on applicable law and the policies of the relevant supplier.

27. Duplicate Reservations

Customers should avoid making duplicate or overlapping bookings for the same traveller, dates, flight, hotel, or destination.

Suppliers may cancel bookings they identify as duplicates, and cancellation or no-show penalties may apply.

28. Group Reservations

Group bookings may have separate payment schedules, deposits, amendment rules, cancellation conditions, passenger-name deadlines, and supplier requirements.

Any group-specific conditions communicated to you will apply in addition to these general terms.

29. Special and Promotional Fares

Discounted, promotional, negotiated, or special fares may carry additional restrictions.

Such fares may be non-refundable, non-transferable, limited to particular travel dates, unavailable for changes, or subject to other specific booking conditions.

30. Fraud Prevention and Verification

For security purposes, Netcare Travels may carry out reasonable verification checks before processing or confirming certain transactions.

We may request additional information where a booking or payment appears unusual, incomplete, unauthorized, or potentially fraudulent.

Where legally permitted, a transaction may be declined or cancelled if satisfactory verification cannot be completed.

31. Chargebacks and Payment Disputes

If you believe a payment has been processed incorrectly, please contact our support team so that we can investigate the matter.

When responding to a payment dispute, Netcare Travels may provide the relevant bank, payment processor, or card provider with supporting information such as booking confirmations, invoices, payment authorization records, and customer correspondence.

We aim to keep the information displayed on our website accurate and useful. However, travel information can change frequently and may be supplied directly by third-party providers.

Prices, schedules, photographs, hotel facilities, descriptions, availability, and similar information may therefore change without prior notice.

We may occasionally suspend or limit access to parts of our website for maintenance, security improvements, technical updates, or other operational reasons.

We cannot guarantee that every online service or feature will remain available without interruption at all times.

Airlines, hotels, transport companies, tour operators, and other third-party suppliers are independently responsible for delivering the travel services they provide.

To the extent permitted by law, Netcare Travels is not responsible for a supplier's independent operational decisions, service failures, cancellations, delays, overbooking, or other acts or omissions.

39. Limitation of Liability

To the fullest extent permitted by applicable law, Netcare Travels will not be responsible for indirect, incidental, special, or consequential losses resulting from circumstances outside our reasonable control or from the independent actions of a third-party travel supplier.

Nothing in these terms is intended to exclude or restrict any legal right or liability that cannot lawfully be excluded.

40. Privacy and Personal Data

We may collect and use personal information where necessary to arrange bookings, process payments, communicate with customers, prevent fraud, provide support, and fulfil travel services.

Information may also be shared with airlines, hotels, payment providers, booking partners, and other suppliers where necessary to complete your reservation.

41. Intellectual Property

Unless otherwise stated, original website content, branding, graphics, text, and design elements belonging to Netcare Travels may not be reproduced, distributed, or commercially used without authorization.

Third-party names, logos, trademarks, and other materials remain the property of their respective owners.

42. Complaints and Customer Support

If you experience a problem with your reservation, please contact us as soon as possible so that our team can review the matter.

Please provide your booking reference, passenger name, travel date, and details of the issue to help us investigate your request efficiently.

43. Dispute Resolution

If a disagreement arises regarding our services or a booking, we encourage customers to contact us first so that both parties can attempt to resolve the matter fairly and in good faith.

Any unresolved dispute will be handled in accordance with applicable law and any mandatory rights available to the customer.

These terms and any dispute relating to our services will be governed by the laws applicable to Netcare Travels Pvt Ltd and the relevant transaction, subject to any mandatory consumer protections that may apply.

45. Severability

If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue to remain effective to the extent permitted by law.

Netcare Travels may update this Agreement from time to time to reflect changes in our services, business practices, website functionality, or legal requirements.

The latest version will be published on our website. Changes will apply in accordance with applicable law.
